I, _____________________________, am submitting this affidavit to Flying Cloud Press, Inc. & Home Theater Builder Magazine ("Sponsor") with the understanding that it will be relied upon in connection with my entry in the Home Theater Builder Project Contest that commenced on or about June 1, 2002 (the "Promotion").

1. I hereby affirm that (i) my date of birth is _______________, (ii) my social security number is ____-___-____, (iii) I am a legal resident of the United States, and (iv) I reside at ________________________________________________. The "Home Theater Builder Project Contest" contest is open only to U.S. residents (excluding Puerto Rico, U.S.V.I. and where prohibited by law) 18 years of age or older at time of entry. Contest is not open to employees of Flying Cloud Press, Inc. or Home Theater Builder Magazine and each of [its/their] respective affiliates, subsidiaries, and advertising or promotional agencies, and the immediate family members of, and any persons domiciled with, such employees.

2. I further affirm that I am not now and was not at the time I entered the Promotion an employee of Flying Cloud Press, Inc, Home Theater Builder and that none of the members of my immediate family or other persons with whom I am domiciled are now or were at the time I entered the Promotion employees of Flying Cloud Press, Inc, Home Theater Builder. I further affirm that I have complied with all of the rules and regulations of the Promotion, that I have committed no fraud or deception in entering or participating in the Promotion, and that my entry is my original work. I agree to return immediately to the Sponsor any prize or the value of such prize which has been or may be awarded to me if any statement made by me in this affidavit is false.

3. I hereby waive and release, for myself and for my heirs, executors and administrators, any and all rights, claims and causes of action whatsoever that I may have against the Sponsor. For purposes of this waiver and release, "Sponsor" includes of Flying Cloud Press, Inc, Home Theater Builder, its parent, subsidiaries, affiliates, officers, directors, owners and employees, and its advertising and promotional agencies, and their respective officers, directors, partners, owners and employees. This waiver and release covers, without limitation, any damage, liability, costs, attorneys' fees and expenses whatsoever arising directly or indirectly out of my acceptance, utilization or possession of any prize that may be awarded to me in the Promotion, and includes, without limitation, claims based on personal injury, property damage, libel, slander, defamation, invasion of privacy/publicity, portrayal in a false light and any claim relating to the exercise of the rights granted in Paragraph 4, below.

4. I hereby grant to Sponsor and its affiliates and advertising, promotion and production agencies, and their respective assigns, the absolute right and permission to use my name, likeness, voice, opinions, biographical information, submitted project picture, submitted 3 paragraph project description, hometown and state for promotional purposes in the Home Theater Builder magazine, the hometheaterbuilder.com website and in any and all advertising and promotional materials, in any manner or media whatsoever, for purposes of advertising, trade or promotion. I acknowledge and agree that I shall have no right of approval, no claim to any compensation, and no claim arising out of the use, alteration, or distortion of my name, address, photograph or likeness.
